Is this Lead Issue going to make these overseas sellers to do the same thing too?  To proof their products are safe to come into this Country?  How can you control them?  I have seen some Hongkong sellers clearly advertise they ship their packages by marking them as &quot;GIFT&quot; on Custom Form  when they ship, so they can skip Custom Check...Tax....Recalls....

Mr. Olson writes =  “It’s hard to believe, but true: under a law Congress passed last year aimed at regulating hazards in children’s products, the federal government has now advised that children’s books published before 1985 should not be considered safe and may in many cases be unlawful to sell or distribute. Merchants, thrift stores, and booksellers may be at risk if they sell older volumes, or even give them away, without first subjecting them to testing—at prohibitive expense.”

“Among its other provisions, CPSIA imposed tough new limits on lead in any products intended for use by children aged 12 or under, and made those limits retroactive: that is, goods manufactured before the law passed cannot be sold on the used market (even in garage sales or on eBay) if they don’t conform. The law has hit thrift stores particularly hard, since many children’s products have long included lead-containing (if harmless) components: zippers, snaps, and clasps on garments and backpacks; skateboards, bicycles, and countless other products containing metal alloy; rhinestones and beads in decorations; and so forth. Combine this measure with a new ban (also retroactive) on playthings and child-care articles that contain plastic-softening chemicals known as phthalates, and suddenly tens of millions of commonly encountered children’s items have become unlawful to resell, presumably destined for landfills when their owners discard them. Penalties under the law are strict and can include $100,000 fines and prison time, regardless of whether any child is harmed.”

And these businesses also can not allow anyone to have access to their dumpsters so now all dumpsters are going to have to be locked when any of these items are thrown in them.

I just wonder how eBay is going to “police” all the ads that seller’s still have active selling these banned items as according to articles I read, company’s such as eBay are responsible for making sure that none of these products are offered. 

In my opinion, making children’s products safer has now become the job of the United States Government due to that same United States Government allowing big business to OUTSOURCE the manufacture of so many products to foreign company’s and those same big businesses being so greedy and allowing the use of cheap materials and ingredients in the manufacture of products. Also, the news has shown and preached for years that some parents are not responsible in watching and monitoring their children like they should or making sure that the child care places they leave their children at do not have banned and illegal products and items, or even have enough employees to monitor the children they take in every day. So, now the US Government also has to be the parent for all children. 

My parents never allowed me to chew on books or houses and always knew where I was and took excellent care of me. Of course, way back then in the 1950’s and 1960’s there were not as many of these man made materials as are available now. But there was more lead based paint and all inks had lead in them. So of course, all those beautifully illustrated books and colored book covers had lead in them that are now ”illegal to be accessible to children”. I remember when a lot of children’s books were made from fabric that I now know was colored with lead based paint and ink. And Yes, I still have every book I ever received as a child. Of course they are all Vintage Collectibles now (ha ha). Of course, I will never part with them; but after I am dead, I would still hate for them to be burned or to go to landfills.

So I am also wondering how the US Gov is going to allow all of these books and other items to be disposed of without causing considerably more damage to the environment by pollution. Are more incinerators and landfills going to be built? We are talking about millions and millions of books. Since all children’s books published before 1985 are now banned and illegal to be accessible to children, including all library’s and books reseller’s. And according to the law, they can not be given away or sent to any other country. They must be disposed of.

If I owned a mortar and brick bookstore I would immediately put up a sign on the door stating
that due to the New Federal Law Passed by the United States Government, the Owner can no longer allow anyone under the age of eighteen in the store at any time, including children with parents. I previously owned a business where I sold all kinds of paints, materials and chemicals to make paints and I had a sign on the front door stating that no one under the age of eighteen was allowed on the property and I never had any problems whatsoever. Legally, since no one under the age of eighteen can enter into a contract to buy; I was within my right. 

I also believe these American businesses knew exactly what they were doing and also knew there were no laws against it until now; so of course they used cheaper materials instead of paying for the more expensive safe materials. Just do your own research on how many businesses moved their operations to countries like India, Malaysia, the Orient, Mexico, Central America and South America years ago. These American company’s and Business Men and Women go to county’s who do not have laws against the manufacturer of products using materials and ingredients that are outlawed in the United States. 

The same is true with FOOD Products. Do you realize that most of the food, fruit, etc. grown outside of the United States is grown using pesticides, fertilizers, etc. that are banned in the United States and these country’s also do not have the same health laws and requirements, etc.
I personally do not buy any food that I know is grown or packaged outside of the 50 States of the United States (and the District of Columbia to be politically correct - although I doubt any foods, fruit, etc are grown and or packaged there - now Nuts is another story- ha ha - I just could not resist throwing that in).

This is really going to hurt people who shop at thrift stores for clothing and items they can afford for their babies and children. Just wait and watch all the closings of the Dollar Stores and Church and other Non Profit Thrift Stores. The same American big businesses that caused all of this mess are going to be the ones who end up making even more money when the smaller retailers, mom and pop stores, flea market stores and Church and other Organizational and Non Profit thrift stores are forced to close.

EMAIL ALL STATE GOVERNORS, LEGISLATORS, CONGRESS MEN AND CONGRESS WOMEN, SENATORS, ETC. Even if you do not live in that State. It is easy to get their email addresses on the web. Just tell them you sell online and voters in their states purchase from sellers like you and this law is going to hurt everyone but especially the lower and middle class Americans.

ALSO EMAIL THE PRESIDENT.. AND ASK HIM IF THIS IS PART OF HIS PLAN FOR CHANGE…? I know Pres Bush signed the Law last year; but any President can see that any law is changed. I emailed all of the above, plus Oprah, Dr. Phil, 60 Minutes, the Today Show, and every other TV show and everyone else I could think of that has a Big Voice on TV or is a noted celebrity fighting causes for the poor.</description>

		<description>Yes, that is true there is a one year stay,but everyone is still liable come Feb. 10,2009.The fines are 100K &amp; 5 years imprisonment.Dont think because the commission is understaffed they cant get you, it is written into the act giving direct athourity to the State Attorney General in every state to prosecute violaters.The logical thing would be to extend the inactment date to coincide with the certification date so the questions can be answered and we can attempt to comply.Making childrens products safer is a good thing but this law is going to destroy alot of industries and put hundreds of thousands of people out of work.Also for those who can afford 3rd party testing be aware of inacurite tests.I know of two of my suppliers who sent same swatches of materials to a lab and two passed while one failed.The other sent a batch of ink in the same manner with same results from a seperate lab.So good luck to us all and hope for the best.</description>

CPSC Grants One Year Stay of Testing and Certification Requirements for Certain Products
WASHINGTON, D.C. - The U.S. Consumer Product Safety Commission voted unanimously (2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans.

Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits (600 ppm), phthalates limits for certain products (1000 ppm), and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements. 

The decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted. 

The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay.</description>

		<description>Yes, Thank you for defending small business operations, Sarah and Plankton. I started making childrens wear after my son was born beause I wanted something better for him than baby gap..mattel..or any other big manufacturer. 
I use organic cotton and recycled fabrics to make my garments and toys. Organic cotton made in the USA that now needs to be tested for lead. There is something seriously flawed about the law when a homemade business that cares about her product and community is put out of business. 
Well ANN, enjoy buying &quot;safe&quot; clothing from large, polluting corporate giants...the ones responsible for the whole lead mess in the first place. You should put your trust in them deeply because they have always had the safty of children at heart. Not coating there pockets with money from cheap Chinese made goods tainted with lead.</description>

I am a stay at home mom who cannot afford to dress my 3 children in good quality clothes without finding deals on Ebay. 

I would appreciate more clarity on the clothing restrictions and penalties.  I also sell my children&#039;s clothes from time to time (for example, I paid for our Christmas this year with the funds received from selling on ebay--that looks impossible for this year).

This Act is going to have ramifications that will be felt in areas we have not even considered...This is not the kind of change I was told about!!!</description>

		<description>On what Minnesota Mike was saying, what isn&#039;t the testing being done at the base of the problem? Where the stuff is made!!! Companies should be resposible for making proper stuff. Like for the people that make children&#039;s clothing, the fabric or zipper they buy should originally be safe straight from the plant.
This whole law is totally illogical! It&#039;s as if there is an alternate motive or jealousy somewhere inside the system.
There&#039;s a lot more things out there and in our houses with lead and poisonous things that contribute to children&#039;s poisoning. Why does the government let winning parents bully them into laws like this, thinking that the government is going to make lead disapear? Parents need to be responsible for thier own house holds.</description>
